What does the Freehold Property Act govern?

The Freehold Property Act governs the rights and duties of freehold flat owners as well as the management of, and decision-making in, the community of owners.

The Austrian Freehold Property Act, known as the WEG, is the legal basis for owned flats in Austria. It governs how several owners jointly own a building, which rights and duties they have and how decisions are taken. Without this framework, living together in a community of owners could not be ordered.

What the Act covers

Freehold ownership and shares

The Act describes what freehold ownership is: the right to use a particular flat alone, combined with a share in the property as a whole. Common parts such as the roof, façade or stairwell belong to everyone jointly.

Rights and duties

It provides that owners may use and dispose of their flat, but at the same time must share the costs and show consideration. Details are given in What duties does the owner of a freehold flat have?.

Management and resolutions

The WEG also governs how the property is managed and how the community takes decisions. How that works in practice is shown in How does decision-making work?.

The Freehold Property Act is the set of rules that turns many individual owners into a functioning community.

Why a basic grasp pays off

You do not need to know the Act by heart, but the essentials help you make better sense of the community's decisions. Anyone who knows which matters are decided jointly and which each owner settles for themselves discusses things more objectively and avoids conflict. With complex questions, such as larger refurbishments, disputed resolutions or challenges, the details matter. That is precisely where legal experience in the management company is a real advantage, because mistakes are avoided early. We explain the relevant points to you in plain language, without legal jargon, and guide your community safely through every decision. That way you pass resolutions with confidence and on a clear basis.

Why this is relevant for you

Anyone who buys or owns a freehold flat is automatically part of these rules. An experienced management company knows them in detail and makes sure your community acts lawfully. With disputed questions in particular, legal expertise pays off. We look after communities of owners in Graz and the surrounding area and guide you safely through the legal requirements.
